Is it Legal to Ship Cannabis Seeds in the United States?

Maryland and Minnesota just got legalized and there’s a ton of new growers who have a healthy fear of what is legal or not when it comes to shipping cannabis seeds. Marijuana or “marihuana” is listed as a Schedule 1 drug under the controlled substance Act. Marijuana is defined by the controlled substance act as All parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin.

Both the United States Post Office and Customs agree that shipping cannabis seeds from state to state and into the country is 100% legal.

However, In the United States, the legal status of possessing cannabis seeds varies from state to state. While some states have fully legalized cannabis for both medical and recreational use, others maintain strict prohibitions.

The 2018 Farm Bill, which legalized industrial hemp, classifies hemp as cannabis with less than 0.3% THC content. Since hemp is federally legal, cannabis seeds fall into that classification and is excluded from the Controlled Substance Act.

It is important to exercise caution, as interpretations of federal and state laws can vary. Some states explicitly criminalize the sale and possession of cannabis seeds, even if they do not contain THC.

The legal landscape surrounding cannabis is always changing but my site will always try to stay up to date on it. Some states that previously had strict regulations against cannabis may have changed their laws or regulations since my last update. Additionally, other states may have specific regulations or restrictions on cannabis seeds that are not explicitly mentioned here.

As of my knowledge from research done on August 11th, 2023, The following states are illegal:

Idaho: Idaho has maintained a very strict stance against cannabis. “A producer license authorizes a person or entity to obtain and possess hemp seed for planting; to cultivate and harvest hemp; to transport their own hemp crop; to dispose of or remediate their own hemp; as well as possess and market plant parts.

Even though the 2018 Farm Bill removes hemp from the controlled substance list, no person can grow, handle (possess), or process hemp plants, viable seed, leaf or floral materials without a hemp license issued by the Kentucky Department of Agriculture.

    Just asking for clarification at 3:40 where you are covering the USPS part of it. The first bullet point below the first paragraph where it states "A license from a states Dept of Agriculture authorizing the licensee to produce industrial hemp" does that indicate the sender and not the recipient I’m assuming? Those recipients would be only subject to the possession laws, etc of their states like you talk about later.

    In the seventies we got alot of exotic pot. 10-15 sometimes 20 dollars a quarter ounce Thai bud ,Thai stick, columbian gold, panama red. late seventies early eighties we got alot of well grown local weed Tiller killer, Matanuska thunderweed.Humboldt and good california red haired sativa. Mid eighties there was a big crack down on weed grows . We could still get the skunk and indica.s but the price was high 50 dollars an eighth. By the nineties the Mexican weed just flooded us ,dirt weed but it was cheap 75 a quarter pound or 10-15 dollars an eighth. when Medicinal was legalized we got more green buds again the Ogres and skunks . goood stuff. the mexican weed just stopped at that point (they moved in to our backyard and started growing local). after the legalization alot of the strains became interbread they pretty much bread the good indica strains out of existence. No more sticky icky icky . The pot is good now . very high THC content but the flavors and smell have been changed Gone are the days of the true skunk weeds. I buy at a local dispensary occasionally but still havent been able to find the quality we used to get . I think weed is too mass produced now . not many worry about quality when there is money involved. I have pictures of a grow i did with my brother we are holding three foot long buds of some of the best sticky icky you can find … i miss those days.

    It is legal because it’s unconstitutional to make cannabis illegal. Last time I checked in the Constitution. It doesn’t mention anything about cannabis being illegal. And and any amendment to the Constitution is null and void to invoke these asinine laws just to create profit. If I remember correctly it was Thomas Jefferson said. If a law is created that is unconstitutional, it is null and void and law enforcement. And anybody else should not Enforce it because that is how our constitutional republic is supposed to work. I mean, seriously think about it. Our forefathers were a bunch of heavy drinking pot heads, if they thought cannabis should be illegal. They would have written it in the Constitution originally same with alcohol Law enforcement simply puts restrictions on use of these substances to make money.
    Which that is unconstitutional and extortion.
