Trump DOJ Move Raises Questions | TDR Cannabis in 5

So here’s the question — why did the Department of Justice under President Trump ask the Supreme Court for more time in a case involving gun rights and marijuana users? On paper, it’s about firearm policy. But beneath it, this case could be a window into how the administration is sequencing federal cannabis reform — and what that means for the broader rescheduling process.

TDR Cannabis in Five, presented by Dutchie, digs into what this move could signal for investors, operators, and the legal landscape ahead. Host Shadd Dales breaks down how cannabis rescheduling, gun ownership rights, and political timing all intersect — and why the Department of Justice’s latest filing might be part of a bigger plan to keep upcoming policy decisions consistent with expected cannabis law changes.

At this stage, nothing’s off the table. Leave your comments below!

Supreme Court case Marbury v. Madison (1803).if a law passed by Congress or a state legislature contradicts the U.S. Constitution, that law is considered invalid and has no legal effect.

It may help ease worry about cannabis being legal if the public is informed about testing equipment. THC breathalyzer use nanotechnology, specifically carbon nanotubes, to detect THC molecules in breath by measuring changes in electrical properties when THC binds to the nanotubes. Enforcement made easy to keep people clean of THC to drive cars or go to work.

  13. @TwitchingLima on October 30, 2025 at 6:18 pm

Ah, this could be strategic. Trump might want the court to uphold that Schedule I drug users don’t have gun ownership rights so that he can reschedule and be a hero to both reform advocates and the 2nd amendment — 2 politically popular moves in one. If that’s the case we’re looking at Q1 26 like Shadd says. Keep your shares!

  16. @bill8582 on October 30, 2025 at 6:20 pm

The gun thing is not constitutional. the second amendment clearly states, "shall not be infringed." If you can carry a gun and you are one who drinks alcohol, how would that be fair? Enough of the refer madness, outdated BS laws. Give the people what they want. We’ve been through enough shit that we ought to be able to relax with some cannabis.

  17. @docsoulman9352 on October 30, 2025 at 6:22 pm

So if Trump’s DOJ rules against gun ownership for weed users and wins then you can forget about rescheduling…there will be our answer as to their position on the matter.

  22. @misterjim5847 on October 30, 2025 at 6:26 pm

My thoughts are that the DOJ delay is to allow time to reschedule cannibus this year. That way the current case stops where it is, without a SC ruling. This allows DOJ to continue enforcement against the other Sch 1 drugs. If the case continues and the court rules against the DOJ this would open the door to heroine addicts owning firearms.

  23. @its.ryan.jensen on October 30, 2025 at 6:26 pm

Shouldn’t we be talking about Canada possibly restructuring the excise tax next Tuesday? Wouldn’t that be a huge boost for the pot stocks? Is it likely not happening now or something?

  24. @davidbrace7712 on October 30, 2025 at 6:28 pm

As long as Big Pharma continues to give lavish contributions to our Government officials for their political campaigns like they did for Obama which brought us Obamacare our Lawmakers and the Executive branch are not interested in giving up that cash cow so America’s 70% to 80% of potheads that want it legalized can have their herb legal. They are just lying as usual & giving us sweet pillow talk as leverage to get our votes, yeah, that includes Trump. Like I said, Big Pharma will stop or severely diminish those contributions if our Government officials who happen to be the beneficiaries of those contributions legalize or reschedule cannabis. We all know that any money left over or not spent for their political campaigns from contributions goes directly into our politicians pockets! The will of the people be damned! C’mon people, use the noodle between your ears. I’m not stupid nor are you. Under the circumstances I just pointed out we are wishing on a pipe dream. It will never be legal or rescheduled.

  25. @BobbyWebster68 on October 30, 2025 at 6:29 pm

  27. @davidbrace7712 on October 30, 2025 at 6:31 pm

Marijuana thc is a "psychoactive" drug so therefore Medical marijuana users can’t own firearms according to our Government. Alcohol, also a "Psychoactive" drug known to cause erratic & violent behavior when consumed in larger amounts has no such restrictions for the ownership of firearms. Hypocrisy on the highest order!

Makes sense. Let the 2nd amendment play out first, what I heard Hemani was not the person neither the 2nd Amendment or cannabis users would have wanted, ie he has other legal issues. He also had no medical card, so when cannabis is rescheduled this case would be over and if it was rescheduled the change in the law would not benefit him. It also give the time for the right roll out. Good observation.

  31. @jeffquincel on October 30, 2025 at 6:43 pm

You could be right, it could also be because of the recent bruin decision that requires all gun laws to be pinned up against text and history of second amendment rights in America. Which there is no text or history that dates back significantly regarding marijuana use and gun rights being taken away, so they could be preparing for that argument in court, because it is a heavy argument that could change everything.

65 million people smoke weed it’s not nice to tell someone you’re going to have an answer in 2 weeks on rescheduling and wait 60 days that’s 65 million voters that work for you. I think that the president has too much on his plate and needs to slow th(f*** down)
I could care less if it’s rescheduled I’m not on the stock market and there’s no heart in cannabis quality anymore💔.
I think we should get away from the Ronald Reagan and Nancy Reagan just say no days this is 20/25 put a Barcode on it Surgeon general’s warning and move the f*** on.
I’m growing my own anyway much better than the industry 😮.
I hope everything’s Growing good for you 💯👍🙏. I think it’s all about the stock market every time something said about this stupid rescheduling the stock market booms and everybody makes money 💰🤑.
It’s just like the vaccines those are on the stock market to the more they give you the more money they make.
Even though it’s free for you to take.
I don’t take vaccines none of them ever if you paid me.
I’ve only been dealing with this cannabis industry for 60 years let’s move on😮. The alcohol industry in the big pharma industry are losing lots of money because people are moving to cannabis they need to get the f*** over it that’s been the problem the whole time.

  38. @jeffrdnck7973 on October 30, 2025 at 6:49 pm

Trump is not stupid, he will de-schedule prior to the midterms and after SCOTUS decides correctly that cannabis use is NOT grounds to restrict firearms ownership.

  39. @erikwithak-t1k on October 30, 2025 at 6:51 pm

I have a final deportation order for planting about 30 plants in Florida. I was a resident. I have been under ICE supervision for 15 years and I only ask God that they finally decriminalize or something that will help me recover my residency to save myself and stay with my family. Thank God, I have a lawyer, I hope to have immigration relief.

I listened to Trump’s response to the question on the WSJ leak and what struck out was a comment he said, that rescheduling is a complicated matter, so it makes sense their are so many moving parts and his few weeks comment was an understatement of the work that’s currently going on.

  45. @philkirkpatrick4512 on October 30, 2025 at 6:57 pm

I truly feel Trump isn’t going to make a move on this anytime soon. Reason being, this administration has had a number of huge victories in a short amount of time. The democrats have been pushing for this for years. Trump will get it done before the democrats but there’s no urgency to get it done this year or early next year. You have to realize it will get the Republicans more voter support during election times if we pass this. But why waste that card now? He can use it later during his term to capture the votes during the next election. That could be for mid terms or the big election of 2028.

  46. @Frank-pe9pk on October 30, 2025 at 6:57 pm

How are you going to do that when it’s legal in Canada? He doesn’t care about our health. He just wants your vote!!!! OVER IT!!!!!!
